JoySelect does not manufacture, warehouse, or ship physical products. Our Services consist exclusively of professional advisory, curation, selection, and consulting work. Any physical products recommended or curated are purchased by the client directly from third-party retailers or vendors unless otherwise agreed upon in a separate written arrangement.

2. Acceptance of Terms

By visiting our website, placing an order, or engaging our Services in any capacity, you ("Client," "you," or "your") confirm that you:

  • Are at least 18 years of age or have the legal authority to enter into binding agreements;
  • Have read, understood, and agree to be bound by these Terms of Service;

  • Corporate Gift Selection — Professional gift consulting for businesses seeking appropriate gifting solutions for employees, partners, clients, and corporate events.
  • Luxury Gift Consulting — Advisory services for clients seeking premium, high-status, or luxury gift options for significant occasions.
  • Last-Minute Gift Recommendations — Expedited gift curation for time-sensitive situations, providing fast and relevant options without extensive lead time.
  • Themed Gift Box Creation — Design and curation of themed gift sets tailored to specific occasions, moods, or recipient interests.
  • Gift Ideas for Kids, Couples, and Families — Curated gift recommendations for children, couples, parents, friends, and families across all age groups.

The specific deliverables, scope, timeline, and pricing for each engagement will be outlined at the time of booking. Service descriptions on our website are provided for general informational purposes and do not constitute a binding contractual offer until confirmed by JoySelect in writing.

4. Ordering and Payment

All orders are processed through our website. By completing a purchase, you authorize JoySelect to charge the payment method provided for the total amount displayed at checkout, including any applicable taxes and fees.

  • All prices are listed in United States Dollars (USD).
  • Payment is required in full at the time of purchase unless a separate payment arrangement has been agreed upon in writing.
  • We accept major credit and debit cards and other payment methods as displayed at checkout.
  • JoySelect reserves the right to modify pricing at any time. Price changes will not affect orders that have already been confirmed and paid.
  • In the event of a pricing error, JoySelect reserves the right to cancel the order and issue a full refund.

5. Delivery of Services

Because our Services are delivered digitally (via email, document, or online consultation), delivery timelines will be specified at the time of your order. Standard delivery timelines are as follows:

  • Standard Services: Delivered within 3–7 business days of purchase confirmation.
  • Last-Minute Recommendations: Delivered within 24 hours of purchase confirmation, subject to service availability.
  • Corporate and Luxury Consulting: Timeline agreed upon on a per-project basis.

JoySelect will make every reasonable effort to meet stated delivery timelines. However, delays caused by incomplete client information, force majeure events, or circumstances beyond our reasonable control do not constitute a breach of these Terms.

6. Client Responsibilities

To enable JoySelect to deliver high-quality Services, you agree to:

  • Provide accurate, complete, and timely information regarding the gift recipient, occasion, budget, and any specific preferences or restrictions;
  • Respond promptly to any requests for additional information or clarification;
  • Use the recommendations provided exclusively for lawful, personal, or business gifting purposes;
  • Not reproduce, resell, distribute, or commercialize any deliverables provided by JoySelect without prior written consent.

7. Intellectual Property

All content on the JoySelect website — including but not limited to text, graphics, logos, images, service descriptions, methodology, and design elements — is the exclusive property of JoySelect or its licensors and is protected by applicable United States and international intellectual property laws.

Personalized gift recommendations, curated lists, and consulting reports delivered to clients are provided for the client's personal or internal business use only. Unauthorized reproduction, distribution, or resale of any such deliverables is strictly prohibited and may result in legal action.

8. Disclaimer of Warranties

JoySelect's Services consist of professional opinion and advisory recommendations. While we apply expertise and care to every engagement, we cannot guarantee that any recommended gift will be received favorably by the intended recipient. Gift selection involves inherently subjective personal preferences. Our recommendations represent our best professional judgment based on the information you provide.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JOYSELECT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits or anticipated savings;
  • Dissatisfaction of a gift recipient;
  • Failure of a third-party retailer to fulfill an order;
  • Delays in third-party shipping or product availability;
  • Any outcome resulting from the use of our recommendations.

In all cases, JoySelect's total aggregate liability shall not exceed the amount paid by you for the specific Service that gave rise to the claim.

10. Third-Party Links and Vendors

Our recommendations may include references to third-party retailers, vendors, or marketplaces. JoySelect does not endorse and is not responsible for the products, services, pricing, availability, quality, shipping, or return policies of any third-party vendor. Any transactions between you and a third-party vendor are solely between you and that vendor.

12. Governing Law and Dispute Resolution

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration in connection with any dispute with JoySelect.

14. Severability
